Employer of Record blueprint

Reduce administration through a lawful employing model.

Strategic business case

An EOR arrangement may help a foreign multinational, regional group or expanding business employ eligible staff through an authorised UAE employing structure rather than immediately creating its own direct employment infrastructure. The value is coordinated administration and a clear local employer interface. The legal design must still consider the nature of the client’s activity, where work occurs, commercial licensing, tax exposure and any sector-specific restrictions.

Scope of coverage

The scope can include employment terms, the permitted work and immigration route, employee records, applicable health insurance, payroll, leave administration and exit settlement. Mainland, free-zone, DIFC and ADGM requirements are assessed separately. PEO, visa hosting and payroll are market terms that require a precise contract; neither an EOR label nor third-party sponsorship gives unrestricted permission to work anywhere in the UAE.

Sourcing and vetting methodology

For a client-nominated hire, the team verifies identity, qualifications where relevant, role eligibility, assignment acceptance and the required checks before an offer or transfer proceeds. Where recruitment is also needed, the same structured sourcing and assessment framework applies. The employing entity’s licence, establishment capacity, required agreement and permitted assignment route are verified before headcount is accepted into a launch plan.

Regulatory and employment controls

The agreement identifies the legal employer, permitted sponsor, client supervisor and ownership of pay, benefits, worksite safety, disciplinary decisions, termination and records. Bilingual documentation and Ministry forms are used where required by the applicable process, with the offer, contract and HR master data reconciled. The authorised employer must control employment changes; client daily supervision does not allow unilateral salary deductions, passport retention or work beyond the permitted assignment.

Deployment and service levels

The onboarding schedule starts from a complete approved file and confirms each authority, insurer, banking and client-access dependency. A release date is set when the route is feasible, not as a universal rapid-entry promise. Payroll cut-offs, funding dates, approval deadlines and exception handling are agreed before the first pay cycle. Statutory wage and benefit obligations do not pause because the client approval or invoice is late.

Post-placement account governance

Monthly governance covers active-worker reconciliation, permits and insurance expiry, time and pay changes, leave, benefit cases, employee queries and projected end-of-service liabilities. Material changes require approved instructions and updated records. The service can reduce administration and clarify accountability, but it does not eliminate every client legal, tax, site-safety or commercial obligation; specialist advice may be needed for the client’s actual market-entry structure.

  1. 01

    Establish the payroll source

Reconcile the active employee population to signed terms and authorised master data. Validate basic pay, allowances, bank/payment-agent details, joiners, leavers, leave and applicable pension or statutory items.

  2. 02

    Calculate and independently check

Apply approved attendance, overtime, variable pay and lawful deductions. Compare period changes, exceptions and control totals; a separate checker reviews the register and the authorised signatory approves release.

  3. 03

Fund and submit the salary file

Confirm funding before the required value date. Prepare and validate the Salary Information File or the approved agent format, then submit through the eligible bank, exchange or payment agent under its current technical requirements.

  4. 04

    Reconcile and resolve

Match accepted files, credit results, rejects and refunds to the approved register. Assign each discrepancy, protect undisputed wages, issue appropriate employee pay information and retain evidence of resolution.

WPS electronic compliance is an operating cycle with funding, data and reconciliation controls. A file accepted by an agent is not alone proof that every employee received the correct amount, and a threshold used by a regulator does not authorise a lower contractual payment. The payroll owner tracks file acceptance, disbursement results and employee-level exceptions through to confirmed resolution.

Current UAE Government guidance identifies Ministerial Resolution No. 340 of 2026 and states that covered wages for the preceding month are due on the first day of each Gregorian month. The account calendar therefore works backwards from the applicable statutory due date, with earlier client input, approval, funding and agent submission cut-offs. Weekends, bank processing, rejected details and off-cycle corrections are planned before the deadline rather than treated as excuses after it.

Payroll evidence includes the approved register, change log, checker approval, funding confirmation, salary-file control totals, agent or bank response and exception closure. These are audit records, not a claim that MoHRE issues a general monthly payroll-compliance certificate. A historical compliance percentage is reportable only after the population, period, due-date definition and result evidence have been established.

Benefits & end-of-service administration

Calculate the entitlement. Identify the funding.

Separate the entitlement, calculation and funding treatment
Benefit/controlAdministration methodCritical qualification
Traditional end-of-service gratuityFor a qualifying foreign full-time employee after one continuous year: last monthly basic wage ÷ 30 × applicable service-day entitlement; 21 days per year for the first 5 years, then 30 days per year.Eligible fractions are pro-rated, unpaid absence excluded and the statutory cap applied. Nationals, other work models and special jurisdictions require their applicable rules.
Final settlementReconcile wages, notice where due, untaken leave, authorised expenses, gratuity or scheme treatment, and lawful deductions.Federal law generally requires final wages and entitlements within 14 days after contract end; a client invoice dispute does not postpone the worker entitlement.
Annual leaveMaintain accrual, approval and balance records under the applicable contract and law. The federal standard is 30 days after a year; more than 6 months but less than a year attracts 2 days per month.Leave pay and exit payment for untaken leave are not assumed to use the same calculation base. Part-time and other regimes require separate treatment.
Accounting accrualReconcile the employer’s projected gratuity or benefit liability to service and salary records each month. An accounting provision is not a segregated cash fund or escrow.
Funded arrangement / Savings SchemeDefine any actually agreed funded mechanism, or valid participation in the approved alternative end-of-service Savings Scheme, with separate records.Do not describe a fund or escrow as active without evidence. Avoid double-counting traditional gratuity for a period covered by the alternative scheme.
Insurance & pensionRegister and renew applicable health insurance; assess competent pension/social-security registration for eligible UAE or GCC nationals.Jurisdiction, eligibility, dependants, scheme, salary base, effective date and contribution rules must be verified.

Transparent fee architecture

Model one component. Review the complete cost.

Use the estimator to model a monthly management-fee component, not the full cost of employment. Enter the headcount and your chosen illustrative per-person management fee; the result is headcount multiplied by that fee. The optional internal budget shows an arithmetic difference against the amount you enter, not a verified saving or a like-for-like commercial comparison.

A formal proposal separates wages and allowances, employer-side statutory or insurance costs, permit and onboarding charges, approved benefits, accommodation or transport where included, management fees, VAT treatment, deposits and any one-off transition work. The quote also states which amounts are pass-through, refundable, fixed, variable or subject to a third-party tariff. Payroll funding and employee liabilities remain visible even when the management-fee component is small.

Before approving a price, confirm the service population, employing model, assignment duration, minimum billing, overtime inputs, change treatment, exit obligations and payment security. The estimator does not determine eligibility, issue a rate card, reserve visa quota or replace a written cost schedule.

EOR and payroll questions

Resolve the model before the first hire.

Does EOR mean a foreign business never needs a UAE licence?

No. The arrangement can address eligible local employment needs, but the client’s own commercial activity, tax or permanent-establishment position, regulated services and operating presence require their separate assessment. An employment service is not an exemption from every market-entry rule.

Does payroll outsourcing transfer legal-employer status?

No. A payroll-only engagement processes specified administration while the client remains employer. Where an authorised EOR or outsourcing entity employs the worker, the responsibilities differ and must be documented in the relevant agreement.

Can gratuity be described as escrowed?

Only if an actual documented and funded arrangement exists. A monthly accounting accrual and participation in an approved alternative Savings Scheme are different mechanisms and should be separately identified.

What happens when a payment is rejected?

The payroll owner records the employee, reason, amount, deadline and corrective action, verifies bank or payment-agent details through the authorised route, and arranges an appropriate correction. The exception remains open until payment is reconciled and the employee communication is completed.

Funding and end-of-service governance

Separate the calculation, cash funding and release.

The service schedule identifies salary pre-funding, security deposits, end-of-service accrual and any separately agreed ring-fenced funding mechanism. A gratuity accounting provision does not itself create escrow. If an escrow or other funded arrangement is adopted, the parties document the account or custodian, contribution basis, reconciliation, permitted release, access, fees and treatment at contract exit.

For a separation, HR verifies service dates, contract status and eligible periods; payroll calculates the applicable wages, leave, notice and end-of-service entitlement; a separate checker validates the result. Finance reconciles any funded balance without treating a client billing dispute as authority to delay the worker’s undisputed entitlement. Final payment, cancellation and records closure follow the applicable legal requirements and documented approvals.
